A federal judge in Delaware ruled Sept. 10 that jurisdiction for Clean Water Act enforcement can be established by using either the plurality or concurring opinions of the U.S. Supreme Court's 2006 Rapanos decision (United States v. Donovan, D. Del., No. 96-484, 9/10/10).
