Court Says Zinc Producer's Costs For Study Are 'Damages' Under Policy

A federal trial court ruled Aug. 10 that costs incurred conducting a remedial investigation and feasibility study pursuant to a settlement agreement with the Environmental Protection Agency are "damages" as defined under an insurance policy issued to a Canadian zinc producer (Teck Metals Ltd. v. Certain Underwriters at Lloyd's London, E.D. Wash., No. 05-CV-411, 8/10/10).
