Court Says Storage Tank Indemnification Bar Does Not Apply to Private Actions

A provision in the Resource Conservation and Recovery Act barring the transfer by indemnification agreement of underground storage tank liability does not apply to actions by private sector litigants, a federal trial court ruled July 8 (Sanchez v. Esso Standard Oil de Puerto Rico Inc., D.P.R., No. 08-2151, 7/8/10).
