Basel Action Network, Sierra Club Sue EPA, Seek Rules for Navy's Marine Ship Disposal

Los angeles-Environmental groups have filed a lawsuit to force the Environmental Protection Agency to adopt rules to prevent the release of polychlorinated biphenyls from the marine disposal of decommissioned military vessels (Basel Action Network v. EPA, N.D. Cal., No. CV 11-6185, 12/9/11). Filed Dec. 9 in the U.S. District Court for the Northern District of California, the complaint takes aim at the U.S. Navy's SINKEX program, where decommissioned ships are used for target practice and sunk at sea. Earthjustice filed the lawsuit on behalf of the Basel Action Network and the Sierra Club. In July, the groups petitioned EPA to initiate a rule-making under the Toxic Substances Control Act to regulate the Navy's disposal of retired vessels.
