EPA Releases Final Rule to Exempt Milk, Product Containers From Oil Spill Rule

The dairy industry will save an estimated $146 million annually under a final rule announced April 12 by the Environmental Protection Agency to exempt milk and milk products from compliance with federal oil spill regulations. In its announcement, EPA said it is formally exempting for the first time milk and milk product containers from the Spill Prevention, Control, and Countermea-sure rule under the Clean Water Act. The final rule will take effect 60 days after publication in the Federal Register (41 ER 1367, 6/18/10). The SPCC regulations, in place since the 1970s, require facilities storing more than 1,320 gallons of oil to create and implement plans to prepare, prevent, and respond to oil spills.
