EPA Sued Over Inaction on Controls For Pollution at Southwest Power Plants

The National Parks Conservation Association and Din£ CARE, a Navajo tribal environmental group, have filed a lawsuit alleging the Environmental Protection Agency failed to require modern pollution controls for two power plants in Arizona and New Mexico (Dine CARE v. EPA D.D.C., No. 1:12-cv-00423, 3/19/12). The complaint for declaratory and injunctive relief, filed March 19 in U.S. District Court for the District of Columbia, contends EPA should have issued federal implementation plans establishing best available retrofit technology (BART) for the plants.
