Advocates Intend to Sue EPA Over Inaction On Texas Power Plant Pollution Exemption

Several environmental organizations announced plans July 1 to sue the Environmental Protection Agency for not responding to their petition to overturn a Texas decision exempting large coal-fired power plants from federal air pollution limits during certain times. The coalition said it filed a notice of intent to sue following a May 2015 petition to the EPA challenging actions by the Texas Commission on Environmental Quality authorizing 30 times more particulate matter per hour from power plants during startup, shutdown and maintenance than allowed by the Clean Air Act.
