For the foregoing reasons, the Court grants the government's motion for partial summary judgment as to liability. Defendants Nedjet Yetim, ASLI & Gizem Realty Corp., and Target Petroleum, Inc. are hereby ordered to immediately cease any and all continuing RCRA violations and to comply with all applicable requirements of RCRA and its implementing regulations governing underground storage tanks as set forth in 40 C.F.R. Part 280. The Court will hold an evidentiary hearing on the government's request for a monetary penalty.
