The cattle industry is urging EPA to exempt concentrated animal feeding operations (CAFOs) from reporting stormwater runoff, an expansion of the agency's controversial Superfund proposal exempting the industry from reporting some emissions. The industry proposal would significantly limit regulatory oversight of agricultural stormwater releases, which are already exempted from regulation under the Clean Water Act, thereby limiting prospects for states and others to pursue suits against the industry for contamination stemming from stormwater runoff. An EPA spokesman did not rule out the industry request, saying the agency is "not at this time" considering such an approach.
