Senate Bill Would Exempt Manure From Regulation Under Superfund Law

Legislation introduced in the Senate would prevent the Environmental Protection Agency from regulating manure as a "hazardous substance, pollutant, or contaminant" under the superfund law. Introduced Oct. 18 by Sens. Mike Crapo (R-Idaho) and Roy Blunt (R-Mo.), the Superfund Common-Sense Act of 2011 (S. 1729) would exempt livestock manure and associated wastewater and emissions from being regulated or held liable as a hazardous substance under Title III of the Comprehensive Environmental Response, Compensation, and Liability Act. The bill, which was referred to the Committee on Environment and Public Works, also would eliminate any reporting requirements on manure from livestock and poultry producers under CERCLA and the Emergency Planning and Community Right to Know Act.
