A federal judge has dismissed on procedural grounds environmentalists' "mega" suit that sought to force EPA to assess the effects of hundreds of pesticide registrations on scores of listed species, setting back advocates' efforts to force the agency to retroactively consult with federal wildlife services on the chemicals' effects and to mitigate them. Magistrate Judge Joseph Spero of the U.S. District Court for the Northern District of California April 22 granted motions to dismiss from EPA and industry intervenors in the so-called "mega" suit, Center for Biological Diversity (CBD), et al, v. EPA, et al, though the court has left a 30-day window for environmentalists to file an amended complaint to correct deficiencies in their prior arguments.
