Ruling Barring Pesticide In Four States May Spur More EPA Species Suits

Activists are touting a federal judge's ruling that effectively bans the use of a widely used rodenticide in four states until EPA consults with other agencies on the pesticide's impacts on endangered species, saying it may spur more suits to force the consultations because the bans are enforceable until the agency completes the consultation process.Judge Ellen Segal Huvelle of the U.S. District Court for the District of Columbia in a July 21 ruling rejected calls from activists to impose a broad injunction scrapping EPA's 2009 registration for the rodenticide under the Federal Insecticide, Fungicide & Rodenticide Act (FIFRA) in the 10 states where it is used. Huvelle delayed issuing a remedy in the case until July 27 pending a hearing on the terms of the relief.
