A federal district judge is weighing whether an EPA pesticide approval is a solitary decision or an ongoing EPA action - a question that may inform whether the judge grants EPA and industry motions to dismiss environmentalists' suit seeking an assessment of harms to 200 endangered species from almost 400 pesticide registrations. Judge Joseph Spero, of the U.S. District Court of the California Northern District, during a March 15 hearing on motions to dismiss, warned parties involved in Center for Biological Diversity (CBD), et al. v. EPA, et al. that it may be some time before he issues a ruling, according to an environmental attorney familiar with the proceedings.
