面对我国旅游市场井喷式发展态势，国家为更好促进旅游业发展，从法律层面加强旅游市场、特别是导游人员的改革创新，开启了导游自由执业模式新探索。本文通过解读《旅游法》及《关于开展导游自由执业试点工作的通知》等文件，结合目前我国特色的旅游市场状况，在导游自由执业试点试行推行背景下，本文从导游道德风险监管与收益博弈模型分析得出监管的必要性和重要性，并针对性提出强化监督监管、提高导游薪酬待遇、增强导游自身素质建设的重要性和急迫性，倡议自上而下、由外至内的“管”“教”齐抓的导游监管制度创新，针对导游自身职业素质水平的提升和职业方向规划提出相关意见。%Faced with China's tourism market development spurt situation, in order to better promote the national tourism development, strengthen tourism market from a legal perspective, especially the reform and innovation of tour guides, opened a free tour guide practice exploration of new models.
