表达自由基础上合理使用制度的重构

摘要

合理使用制度自产生之时就与表达自由相连。合理使用制度是表达自由和版权协调的产物，但随着版权扩张和新技术的冲击，合理使用制度自身的平衡逐渐倾危。一方面，公众的表达自由不断地逼近、触碰甚至翻越合理使用的边界；另一方面，版权人也借助技术措施等手段企图绕过合理使用制度取得更大的利益。表达自由和合理使用制度需要再次回归衡平，通过巩固和完善合理使用制度、灵活运用其它版权框架下的机制，使得表达自由基础上的合理使用制度得以重构。%The fair use system is deeply related to express freedom since it came into being, which is engendered by the co-ordination of express freedom and copyright. However, since the expansion of copyright and the attack of new technologies, the fair use system is now in crisis. The public overstep the boundary of the fair use system, while the copyright owners use technical mea-sures to profit themselves. To regain the balance between express-freedom and fair use system, we try to fix and strengthen the fair use system itself and neatly utilize other systems under the framework of copyright law.
