南海仲裁案后中国南海争端的因应之道

摘要

在当前南海仲裁结果出炉之际，中国在解决南海争端时面临着诸多问题。为破解这些问题，中国唯有在立法上明确在南海的主权范围，破除多边协商解决南海争端的机制，坚持双边协商、区别对待，加强对南海岛礁的实际控制力，掌握南海的制海权、制空权，并向国际社会提供航行、科学研究、环境保护等方面的服务，才能最终实现南海争端的顺利解决。%Currently, China is faced with many adverse issues on solving South China Sea disputes .To break this deadlock , the only solution for China is to clear the sovereignty of the South China Sea in the legislative way , to get rid of a multilateral consultative mechanism to resolve the South China Sea disputes , to insist on a bilateral consultation system and make a distinction between cases , to strengthen actual control ability on islands and reefs of South China Sea , to gain the control of sea and air , and to provide the international community sailing , flying, scientific research, environmental protection and other services in order to achieve ultimate settlement of the South China Sea disputes .
