从产权实施能力看产权界定的重要性——深圳市历史遗留违法建筑确权政策解读

     

摘要

With the rapid industrialization and urbanization, a unique phenomenon of urban villages has existed in Shenzhen. In the past decades, the government has issued many policies to deal with the problem, but in vain. Based on an analysis and evaluation of the local policies for dealing with the illegal buildings left over from history in Shenzhen City, this paper, by applying the theory of new institutional economics and property right economics, holds that we should define the property rights in the process of the property implementation, which includes property confirmation, equity distribution and realization, according to the property implementation. It is concluded that the government should revise the policies in time according to the implementation capacity of them to increase the effectiveness of property confirmation and focus on the negotiation and gambling between different stakeholders to finish property confirmation effectively, thus enhancing property implementation capabilities and ensuring the effectiveness of property implementation.%经过快速的工业化、城市化进程,深圳形成了自身特有的城中村现象,历年来,政府出台过多个政策予以处理,但收效甚微.通过对深圳市历史遗留违法建筑处理政策进行了分析、评判、评估和检讨,利用新制度经济学产权经济学理论,从产权实施能力的角度,提出从产权界定、权益分配和实现整个产权实施的环节来进行有效产权界定,从而提高产权的实施能力.得出政府应该根据政策的实施能力及时修订政策安排,增加产权界定的有效性.在制度安排中,应该更加注重不同利益主体的共同协商和博弈的过程,有效完成产权界定,增强产权实施能力,保障产权实施的有效性.
