依法管理的铁性原则和温情效应

         

摘要

Order and obedience is the main content in the tradi-tional school management. With the vigorous implementation of rule of law and the rise of citizens' consciousness of right, the current school management will inevitably take the frame based on rule of law with negotiation and equality as the main content. However, on the one hand, the law is mandatory, and on the other hand, it also contains fairness, impartiality, justice and goodwill, so the school management according to the law highlights the du-al attributes of both mandatory principle and emotional trait, and school management must adhere to the integration of rule of law and rule of virtue, and the combination of governing education by law and governing the school by virtue.%传统的学校管理是以命令服从为基本内容.随着依法治国方略的大力实施,随着公民权利意识的提高,当前的学校管理必然走向以协商、平等为主要内容的依法治校框架.然而,法律既有冷冰冰、惩恶扬善的一面,也包容着公平、公正、天理和人情,因而学校的依法管理也就凸显出铁性原则和温情特质的两重属性,学校管理必须坚持法治、德治并举,依法治教和以德治校相结合的治理结构.
