中外合作办学独立法人机构章程研究

摘要

中外合作办学是外国教育机构与中国教育机构在中国大陆合作举办教育机构的活动。我国现有8所具有独立法人资格的中外合作办学机构，是中外合作办学形式中规格最高的一种。章程是中外合作大学的架构性法律文件，是依法享有办学自主权、实施内部管理和对外履行社会公共职能的基本依据。中外合作大学章程具有一定的特殊性，但实践中仍存在制定和审批过程民主性科学性不足、稳定性弱、公开性不够、结构不规范、内容繁简不一等大量问题。《高等学校章程制定暂行办法》的颁行是中外合作大学章程规范化管理重要的参考，应以《高等学校章程制定暂行办法》为标准，进一步加强中外合作大学章程规范化管理，提升中外合作大学的办学质量和治理水平。%The Chinese-Foreign Cooperation in running school means the activities of the cooperation between foreign educational institutions and Chinese educational institutions in establishing education-al institutions within the territory of China to provide education service mainly to Chinese citizens.Till today,there have been nine Chinese-Foreign Cooperation Universities with independent legal entities (including one under preparing phrase)which are on the highest-level cooperation according to the law.Charter is the constructional document for inner regulation and outside social relations for a uni-versity,according to which the university is entitled to its autonomy of education too.The Charters of Chinese-Foreign cooperation universities are different with the public universities'and the private u-niversities'.And there exist some problems in drafting and approving process,such as unstable,un-democratic,unscientific,unstable etc.Now,it is necessary to take the newly promulgated “The In-terim Measures for the formulation of University Charters”from the Ministry of Education as the ref-erence to get the charters improved.Through that process,the universities can improve their regula-tion and education quality too.
