现行宪法颁布30年来，基于宪法实施的要求，我国宪法学理论研究体系逐步建立并与宪法实施的状况相适应。在诸多体现宪法的规范特征的宪法学概念中，宪法原则是备受宪法学界重视的核心概念之一。宪法原则兼具宪法形式与宪法内容的特征，属于宪法学描述宪法现象一个最重要和最有效的范畴。30年来，宪法学界从简单确认逐渐发展到运用严密的推理方法来详细加以论证，就宪法的法律特征形成了“宪法原则”与“宪法规范”的两重规范性认识结论。“宪法原则”由于在价值论的起点或顶端，因此，它往往成为判断宪法规范正当性的逻辑前提。%Since adoption of the current Constitution in 1952, fit for the need of constitutional implementation , the system of con- stitutional study of China has been built gradually and complied with the state of constitutional implementation. Of those which can manifest the characteristics of constitutional norm, constitutional principle is one of the core conception emphasized by consti- tutional academy. Constitutional principle not only has the characteristic of constitutional form but also reflects constitutional con- tent , regarded as one of categories of describing constitutional phenomenon most importantly and effectively. In the past 30 years, constitutional academy has justified constitutional principle by way of confirming simply to inferring strictly , and conclu- ded dual norms about constitutional content in shape of both constitutional principle and constitutional norm for expressing legal characteristic of constitutional law. Because constitutional principle is at the top or at the very beginning of axiology , it has be- come the logical premise of judging legitimacy of constitutional norm.
