法学中西之间：西方法学在中国法学理论体系建构中的贡献和定位

摘要

1978年以来，西方法律思想重新进人中国，传播日广，对中国法学理论体系的建构做出了重大贡献，深刻地影响了中国法学之学科体系、理论范畴、观念体系乃至学术流派等方面的形成和建构。当然，也应明确西方法律思想之贡献的性质，清晰定位其能与不能，处理好中国法学理论体系的自主性建构与恰当利用西方法律思想的关系。%Since 1978, the western legal thoughts have re -entered into China and spread widely. It has made a significant contribution to the construction of China law, made a profound impact and influence on the formation of the legal disciplinary, the theoretical category, the concept of system, and even the academic schools. Of course, we should make clear the nature of the contribution of the western legal thoughts, and what they can do and cannot do to Chinese legal theory System. Then under the presupposition of the autono- mous construction of Chinese legal theoretical system, we can reflect on how to make better use of the western legal thoughts.
