全程同步录音录像制度研究——以刑诉法《草案》第120条为引子

摘要

全程同步录音录像在检察院职务犯罪案件侦查中已得到广泛应用，并取得了一定效果，但公安机关在“双录”的应用情况存在着明显差距。为了在公安机关侦查讯问中推行‘‘双录”，应完善法律对“双录”的规定，引导公众正确区分正常讯问和非法讯问，提高侦查人员的审讯素质，改变侦查讯问人员对“双录”的错误观念，对重点案件实施“双录”。%The synchronous recording is widely used in the duty crime investigation of procuratorate, and has achieved some results. However, there are obvious gaps exist when the police organs launch ＂double recording＂. In order to implement ＂double recording＂ in interrogation, the rules of ＂double recording＂ should be perfected, lead people to distinguish interrogation and illegal interrogation appropriately, enhance the investigator＇s quality of interrogation, change the investigator＇s misunderstanding of interrogation, implement ＂ double recording＂ for the crucial cases.
