私人刑事调查的司法审查机制设计

摘要

As an important form of self-protection, private criminal investigation has both positive values and negative values. So, we need to design special judicial review mechanism for private criminal investigation. It mainly includes two aspects: set up the special judicial review organ in the court and clearly define its function and power. Its power mostly includes: the scope of investigation, mode, issuing warrants or ex-post confirmation and exclusion of illegal evidence.%　　作为自我保护与私力救济的重要形态，私人刑事调查既有众多正面价值，亦存在不少负面价值。为真正确保它日后实现兴利除弊，必须对私人刑事调查进行司法审查机制设计。这主要包括在法院内设置专门的司法审查机关和明确该机关具体职权两方面。其职权又大多涵盖审查调查范围、方式、签发令状或事后核准确认以及进行非法证据排除几部分。
