试析刑讯逼供控制的观念与体制障碍

摘要

The difficulty of torture control comes from two aspects. First,people have a relatively recognition on torture owing to ideology,as a result,improving and carrying out the legal system about torture control become dif-ficult. Second,the judicial system and the structure of criminal procedure are not conducive to the enforcement of such legal system. To control the torture,we should change our recognition and attitude on torture;create the con-ditions for improving and successfully carrying out such legal system. at the same time,to ensure successfully carry-ing out such legal system,we should improve system and structure conditions for law enforcement.%我国刑讯逼供控制的困难主要来自两个方面：首先，由于观念原因，人们实际对刑讯逼供抱有一种相对认可的态度，这不仅使控制刑讯逼供的法律制度难以完善，而且使现行相关法律制度难以实施；其次，我国现行司法体制和刑诉程序结构也不利于这些法律制度的实施。因此要有效控制刑讯逼供，一要改变对刑讯逼供的观念和态度，为相关刑事诉讼立法的完善和顺利实施创造条件；二是要改善法律实施的体制和结构环境，确保这些立法得到严格执行。
