从汉高祖诏令看中国古代政治传统

摘要

This paper aims to study the form, thought and content of the imperial edicts represented by Emperor Gaozu, Liu Bang in Han Dynasty. Combined with the historical background, it also studies the correlation between Emperor Gaozu’s imperial edicts and the political tradition of ancient China. First, Emperor Gaozu’s imperial edicts reflect the formation of open political environment represented by election system. Second, they lay political foundation for the replacement from traditional“law-rule oriented”ruling to“rite-rule oriented”ruling. Third, they provide political practice for the strengthening of centralization. Finally, they provide system premise for reinforcing feudal bureaucratic thoughts.%以汉高祖刘邦诏令为代表，研究高祖诏令的形式、思想、内容，并结合历史背景，探究其诏令和中国古代政治传统的相关性。高祖诏令首先体现了以选举制为代表的开放式的政治环境的形成；其次，为“礼治为主”代替“法治为主”的治国传统奠定政治基础；再次，为中央集权的强化提供政治实践；最后，为强化封建官僚思想提供制度保障。
