TRIPS协定下中国知识产权保护水平测度

摘要

This paper measures the strength of intellectual property legislation level based on the improved GP index under the TRIPS agreement in China and builds the level 3 measurement index system of IPR in view of the executive ability and willingness of the enforcement of intellectual property rights. Quantitative calculation of China's intellectual property rights protection enforcement strength index of ELS and the IGP index after China has entered WTO is conducted, thus the real index of intellectual property protection level in our country can be measured. Results show that the actual level of protection lies between the level of legislation and enforcement strength and it shows a trend of steady rise. Based on the correlation analysis among intellectual property protection level and patent application , trademark and copyright application, it proves the rationality of the results in intellectual property protection level under the TRIPS agreement.%以改进GP指数衡量TRIPS协定下中国知识产权立法水平，从知识产权执法的执行能力与执行意愿角度，构建了测度知识产权执法水平的三级指标体系。定量计算了入世后中国知识产权保护的执法强度指数ELS，结合改进的GP指数IGP，测度了我国实际的知识产权保护水平。结果发现，我国实际的保护水平介于立法水平指数与执法强度指数之间，并呈平稳上升趋势。通过对知识产权保护水平指数与中国专利申请数、商标和版权申请数进行相关性检验，验证了TRIPS协定下中国知识产权保护水平测度结果的合理性。
