In 1904, in his book The Rich History of Chinese Jurisprudence, LIANG Qichao claimed the theories of Confucian jurisprudence belonged to natural law, his conclusion aroused great repercussions in academic world. Since then, the view that natural law exists in the legal and cultural traditions of China has been popular. In the course of the development of China's jurisprudence, there exist many kinds of identical or different writings on this issue, but they ignored the in-depth study of relevant concepts. And identifying the connotations of the relevant concepts, especially the two most important ones, namely, " Natural Law" and "Tao Follows Nature", is precisely important prerequisites for studying this issue.%1904年,梁启超在其所著的《中国法理学发达史论》中认为儒家的法理学理论是自然法,该结论在学术界引起了极大的反响;从此以后,中国法律文化传统中存在自然法的观点便开始盛行.在中国法学发展的过程中,关于该问题求同证异的著述虽层出不穷,但是却忽略了对相关概念的深入研究;而明确相关的概念内涵,尤其是其中最为重要的两个概念即"自然法"和"道法自然",恰恰是研究这一问题的重要前提.
