我国《继承法》修改中应着力协调的三种关系

摘要

Consensus has been reached on the overhaul revision of succession law by civil law scholars. Three kinds of relationship should be coordinated when we determine which legal norms of succession law should be revised. From the perspective of principle of civil law,the testament freedom and restrictions on testment should be coordinated. We should actively response to social changes and the legal development. The relationship between statutory law and customary law of succession should also be coordinated.%民法学界对《继承法》全面修改的必要性已经形成共识，在确定哪些继承法律制度需要修改及修改的幅度时需要相应着重协调三种关系。从民法原理的角度观察，《继承法》修改中应协调遗嘱自由与限制之间的关系；应积极回应社会变迁与法律发展之间的关系；还应协调继承国家法与继承习惯法之间的关系。
