我国著作权登记制度及其完善研究

摘要

Copyright registration system is the path of publicity which the obligee has the freedom to choose. The registration institution of copyright includes ownership registration and transaction registration, both of which are based on the principle of public notification and public trust.There is, however, a great difference between the principle adaptation and the principle of public notification and public trust.By researching the drafts of the third amendment of Copyright Law, we discover that the legislators pay attention to improving the registration system of copyright.The registration system of copyright should aim at five unifications, namely, the unification of the registration institution, the pro-cedures, the serial number, the certificate and the query system.%著作权登记制度是由权利人自由选择的权利公示路径。著作权法的登记制度，大致可分为权利归属登记和权利交易登记，二者都是以权利公示公信原则为法理基础，但著作权登记对于该原则的适用与物权公示公信原则有较大区别。研究现行著作权登记制度相关法条以及第三次《著作权法》修订的历次草案，可以发现著作权登记制度备受重视并不断进行了完善。现行著作权登记制度仍存在诸多实务问题，需要在《著作权法》修订之后加紧制定管理办法。著作权登记制度的目标应当是“五个统一”，即统一登记机关、统一登记程序、统一登记编号、统一登记证书、统一查询系统。
