污点证人豁免制度的构建

摘要

Immunity system of tainted witnesses is to exempt the crimes of tainted witnesses in exchange for the more important evidence, which plays an irreplaceable role in combating bribery with strong concealment and hard evi- dence collection. Although there is a certain conflict between this system and modern concept of the rule of law, however, in order to track down criminals and improve the efficiency of the proceedings, we should learn from the advanced countries and construct a immunity system of tainted witnesses suited to our national conditions.%污点证人豁免制度是通过免除污点证人的罪行来换取更重要的证据,在打击隐蔽性强、取证难的行贿犯罪中发挥着不可替代的作用。尽管该项制度与现代法治观念存在一定的冲突,但为达到侦破犯罪、提高诉讼效率的目的,我国应当借鉴先进,构建适合我国国情的污点证人豁免制度。
