论先秦军礼与儒法思想的形成

先秦军礼作为礼乐文明的重要内容,不仅反映了夏商周三代早期国家文明演进的特色,同时对儒法思想的形成产生了深远影响。在解决时代战乱的问题中,儒家主要继承了西周军礼的政治意义和道德特色;法家则将军礼中的军事秩序原理引入国家法度,发展了内刑外兵的法治理论。%An important part of ceremony and music civilization,military solute in the Pre-Qin times not only showed the characteristics of evolution of national civilization in the Xia,the Shang and Zhou Dynasty but also exerted deep and profound influence on the shaping of Confucianism and legalism.In the practice of solving problems of the current chaos caused by war,Confucians succeeded the political significance and moral character of the military solute in the West Zhou Dynasty while the legalists introduced the principle of military order into national law and developed the legal theory of internal law and external war.
