我国广大农村目前进行的土地产权确认工作，并不是“新一轮农村产权制度改革”，更无力解决现阶段农村集体土地存在的根本问题。对农村土地进行确认、确定的一系列权利，不是赋予村集体和农民个体的新权利，其无力解决农村集体土地原来就存在的侵权、流转难等问题。由于农村集体土地所有权行使主体实际上存在缺位问题，所以只发一个权属证书，对农民集体和农民个体来说，毫无实际意义可言。土地确权登记颁证工作，仅仅是对原来法律允许的流转方式起推动作用，却无力解决阻碍现代农村规模化经济发展的最大问题，即现阶段法律禁止家庭耕地承包经营权和宅基地使用权抵押的问题。%The confirmation of land rights is being carried out in China's rural areas,which is not a new reform of property right system and can't solve the fundamental problems existing in rural collective land at this stage .A series of rights of rural land didn't grant new rights to rural collectives or farmers ,which cannot solve the tort problems and difficulties in the circulation of rural collective lands .Because the subjects of rural collective land ownership are actually absent ,and only certificates of ownership are issued ,it is of no practical significance for the collectives and farmers.The registration and certification of land ownership only promotes the way of land circulation permitted by the former law , but is unable to solve the biggest problems of the prohibition of the mortgage of contracted management rights of family land and the use rights of homestead by present laws .
