法治视野下的公安行政程序问题研究

摘要

我国公安机关办理治安案件存在的问题大多集中在程序上,重实体,轻程序的执法习惯在法治呼声高涨的社会中很容易制造社会矛盾。关注和研究公安行政执法程序问题,解析公安行政执法程序执行上的困难,从加强行政执法程序性训练,完善法律规制以及发挥调解、听证等程序的法律价值等几方面着手,积极回应社会对公安行政执法的程序法治要求。%The issues generated during the process of dealing with public order cases are mostly in the procedure per se,where the practice of emphasizing substantive law and despising procedural law has created social contradictions.Thus,a proactive response to the requirement of police administrative procedure shall start with attaching importance to the very issues of police administrative enforcement of law,analyzing the difficulties in the execution of the procedure of police administrative enforcement of law,enhancing procedural training,improving related laws and regulations and bring out the legal value of mediation and hearing.
