徘徊在扩张与限制之间的精神损害赔偿制度

摘要

In modern risky society ,the system of emotional distress damages tend to expand gradually , w hich is the result of human civilization and development .In the meantime ,the expansive development of emotional distress damages has caused some difficulties within the realm of tort law ,negatively influencing the values and functions of tort law .In order to keep the interior coordination of tort law ,restrictions are generally imposed on emotional distress damages . Wandering between expansions and restrictions , the system of emotional distress damages gradually becomes mature . Reflecting on expansions and restric-tions ,we need to focus on the interior coordination of tort law and balance the interest of various parties .%在现代风险社会，精神损害赔偿制度呈现出不断扩张的趋势，这是人类文明与进步的要求。但与此同时，精神损害赔偿制度的扩张式发展又在侵权法体系内部导致困境，使侵权法的价值与功能受到冲击。为了保持侵权法体系的内在协调，各国法律无不对精神损害赔偿制度施加某种限制。正是在这种扩张与限制之间，精神损害赔偿制度逐步走向成熟。反思精神损害赔偿制度在当代的扩张式发展及其所受限制，必须从侵权法的内在协调需要出发，综合平衡各方利益。
