论我国未成年人人格调查制度之完善

摘要

Personality Inventory is significant for juvenile justice . The new Criminal Procedure Act provides a legal basis for the personality inventory of the minor . But the personality inventory of the minor has many shortcomings , such as the physical law s , the body , the time and the contents . In this regard , it is necessary to establish the entity of the personality under the Criminal Code , establishing an unified investigation agency in the criminal investigation stage , which includes social workers , judicial workers , psychologists and people from the minors protection organization . In the investigation stage , the organization should do the survey . In this regard , all of these can be harmonized through the establishment of Community Corrections Act .%人格调查对于未成年人司法意义重大。新刑事诉讼法对于未成年犯罪人人格调查的开展提供了法律根据，但我国当下的人格调查在调查的实体法律根据、调查主体、调查时间和调查内容上都存在不足。有必要确立人格在刑法中的实体根据，建立起包括社会工作人员、司法工作人员、心理学工作者和未成年人保护组织人员在内的统一的调查机构，在刑事侦查阶段，结合未成年犯罪人的具体情况确定调查内容，以进行人格状况的调查。
