行政强制司法控制的困境与出路——透过案例的钩沉

摘要

Based on the practice of judicial control in Shanghai,we adopt a kind of research approach of empirical analysis to hackle Shanghai No.1 Intermediate People＇s Court＇s cases about administrative enforcement in recent five years,then we probe into the tributes of administrative enforcemnt cases and performances of insufficient judicial control.On the basis of above research,we analyses the causes of insufficient judicial control of administrative enforcement,and finally,combined with the theory and practice of administrative enforcemnet jucicial control abroad,raise some methods to strengthen administrative enforcement judicial control from the perspectives of theory,legislation and justice.%本文立足于上海司法审查实践,采用实证分析方法,对上海市第一中级人民法院辖区法院近五年来行政强制案件进行了较系统的梳理,对行政强制案件的特点以及行政强制司法控制不足的表现进行了深入的分析,在此基础上,较全面地剖析了行政强制司法控制不足的原因,最后结合域外行政强制司法控制的理论和实践,从理念、立法、司法等方面提出了加强行政强制司法控制的若干对策。
