论我国环境公益诉讼制度之建构

摘要

环境公益诉讼制度是西方国家保护生态环境非常重要的一项法律制度，具有监督公民和企业等污染源自觉守法、督促环境主管部门严格执法从而实现环境保护的功能。当前，我国环境污染较为严重，探索在我国建立环境公益诉讼制度，是保护生态环境必要且可行的一条路径。%The litigation system of the environmental public interest is a leading legal system in the western countries for protecting the ecological environment .It exercises a function to supervise the citizens , enterprises and others that may become sources of pollution abiding consciously by the law and to keep the environmental protection departments strictly enforcing the law to consolidate environmental protection operation .Now, the environmental pollution has become very serious in our country , so to explore the establishment of the environmental public interest litigation system will be an indispensable and practical way for the protection of the ecological environment in our country.
