＂The Intangible Cultural Heritage Law of the People＇s Republic of China＂ has filled the gap of legislation in the protection of ICH in China. This law, which will play an important role in guiding the development of the ICH protection, not only has adopted the spirit and essence of the international treaty, but also has taken the situation and characteristics of the Chinese ICH into consideration. In order to fulfill the aims of this law, specific regulations should be made to perfect the ICH protection system in practice, including specifying the rights and responsibilities, giving more help to inheritors, develop- ing ICH products rationally, making full use of productive protection and carrying out more publicity activities.%《非物质文化遗产法》填补了我国在非物质文化遗产保护领域的立法空缺。该法承袭了国际公约的精神和要旨，结合我国非物质文化遗产的现状和特点，对我国非物质文化遗产保护工作的深入开展具有重要的指导作用。为保障该法立法目的的顺利实现，必须针对保护工作的各环节制定具体的规范，明确各方权利义务，加强对传承人的扶持，合理开发利用非物质文化遗产产品，充分发挥生产性保护的优势，加大宣传力度，在实践中不断完善非物质文化遗产保护制度。
