论业主撤销权的行使——以权利冲突和利益均衡为视角

Owner cancellation right as the complement of democratic decision making mechanism can effectively prevent the occurrence of ＂tyranny of the majority＂, but the owner cancellation right cannot exercise freely.To protect the interests of minority owners,the standard should be reasonable,that is whether the owners,the decision of the Committee of owners and the interests of the owners suffered significant imbalance.When the right to dispose is damaged,or the personal safety and property interests of the owners are significant lost,the minority owners have the right to exercise the cancellation right.%业主撤销权作为民主决策机制的补充可以有效防止＂多数人暴政＂的发生,但是业主撤销权不能随意行使。保护少数业主的利益应当以合理性为标准,即业主大会、业主委员会的决定与业主所受利益是否明显不平衡。当业主的处分权遭到破坏,或者业主的人身安全、财产利益受到重大损失时,少数业主有权行使撤销权。
