近年来,由酒驾引起的道路交通事故频频发生,严重危及人们的生命财产安全及社会公共安全。《刑法修正案（八）》的出台将醉酒驾驶作为一种犯罪行为列入我国刑法,为此理论界和实务界争论不休。本文将从醉驾的概念、犯罪类型、罪过形式及其法律适用方面探讨刑法意义下的醉驾性质。%In recent years, road traffic accidents caused by the drunk driving occurred frequently, which endangers people＇s lives and property safety and public safety. The releasing of The Amendments to the Criminal Law of People＇s Republic of China 18}makes drunk driving a crime. It brings out heat debate in the theory and practice circle.
