The paper studies and analyzes the practice of specific issues. It begins with the basis of law regard to mental damage compensation of the identity right of relatives, discusses the function of mental damage compensation system, and analyzes the practice regard to mental damage compensation of the identity right of relatives. The author explains it with the combination of legal doctrines and the practice, and tries to clarify the exact application of mental damage compensation of the identity right of relatives, so that the identity right of relatives could obtain judicial relief and regain its perfect state.
