小议恶意透支型信用卡诈骗--以刘某信用卡诈骗案为切入

近年来，随着信用卡在我国普及程度的日益增强，信用卡违法犯罪活动不断增多，其中恶意透支型信用卡诈骗占据主要部分。本文旨在通过阐述恶意透支的刑法规定和司法实践，在论述恶意透支归入信用卡诈骗罪的危害性的基础上，针对防范和处理恶意透支犯罪，提出建议。%In recent years, with credit card in our growing popularity of credit cards increasing criminal activities, including malicious overdraft credit card fraud accounted for the major part. This article aims to elaborate criminal law and judicial practice of malicious overdraft, discusses the dangers of malicious overdraft classified on the basis of credit card fraud, aimed at the prevention and treatment of malicious overdraft crime and make recommendations.
