浅论国际法与国内法之间的关系

摘要

The relationship between international law and international law in the theoretical circle cause lots of controversy.It is not only one of the inevitable questions for international law,but also a fundamental problem in international law subjects. Their relationship directly affect the nature,status,origin and some other fundamental problems of international law.At the same time,the solution of this problem play a fundamental role for a country to handle contradictions and conflicts between the international law and the domestic law.%国际法与国际法的关系在理论界有着很大的争议，它不仅是学习国际法必然要面对的问题之一，也是国际法学科中的根本性问题。两者间关系直接影响到国际法的性质、地位，渊源与效力根据等基本问题。同时，这些问题的解决也对于国家是否能正确处理国际法与国内法之间的矛盾具有重大意义。
