微信公众平台著作权侵权行为的认定和责任承担

With the rapid development of mobile Internet , it has become a new trend that people create we -media through the mobile Internet . We-chat public platform has become the most popular we -media platform instead of Micro -blog , but there are also more and more copyright disputes . On the one hand , the presence of these controversies is due to the insufficient analysis of transshipment of the micro channel subscription number , creating the different views on the we -chat public platform for copyright infringement ;on the other hand , it is because of the unreasonable place in the copyright law of our country stipulating exemptions in the micro channel public platform , resulting in the uncertain tort liability state . When analyzing the tort and tort liability of the we -chat public platform , we should put analysis of the behavior of the communication subject on the first place , and then reconsider the application of the exemptions on the we -chat public platform , and establish copyright collective management organization of we -chat public platform to protect the copyright owner's legitimate rights .%随着移动互联网的迅猛发展，人们通过移动互联网创作自媒体成为了新的趋势，微信公众平台成为了继微博之后最火爆的自媒体平台，但随之而来的则是越来越多的著作权争议。存在这些争议的原因一方面是由于对微信订阅号的转载行为分析不充分，导致对微信公众平台著作权侵权行为的认定存在分歧，另一方面是因为我国《著作权法》所规定的免责事由在微信公众平台进行适用时存在不合理的地方，使得侵权责任的承担也处于不确定的状态。因此在对微信公众平台中的著作权侵权行为进行认定和责任承担时，首先要对传播主体的行为进行定性分析，然后重新考量免责事由在微信公众平台中的适用，并建立微信公众平台著作权集体管理组织来保护著作权人的合法权利。
