走向国家治理现代化的法治政府建设∗

摘要

Government governance is the major element of state governance system, the legalization extent of which determines the level of the national governance institutionalization. Since the introduction of reform and open-ing policies, we have made great achievements in the construction of law-based government, which provide sub-stantial legislation guarantee for modern state governance. But there are still some deficiencies restricting state gov-ernance capacity in the aspects of government function positioning, administrative policy-making system, adminis-trative law enforcement system, government supervision, information disclosure and so on. To strengthen the con-struction of law-based government under the background of the modernization of national governance, we should implement the power list system, improve the decision-making level, improve the administrative law enforcement system and strengthen government information disclosure.%政府治理是国家治理体系的重要组成部分，其法治化程度在很大程度上决定了国家治理的制度化水平。改革开放以来，我国法治政府建设取得了显著成就，为国家治理现代化奠定了坚实的法治基础。但是，法治政府建设仍然在政府职能定位、行政决策体制、行政执法体制、政府监督、信息公开等多方面存在诸多问题，制约了政府治理能力的提升。在国家治理现代化背景下，加强法治政府建设亟需推行权力清单制度，提升依法决策水平，健全行政执法体制，加强政府信息公开。
