论秘密收养制度

摘要

As a main way of adoption,closed adoption plays an irreplaceable role in the whole system of adoption.Although the emergence of open adoption shaken the legal status of closed adoption in a certain extent,closed adoption still has a vast living space.But the closed adoption system after all retained the inherent problems,which we had to avoid.In view of this point,taking some measures such as handling the problem between child’s rights of privacy and parents’right to know,refining methods of bearing civil liability,and clearing the validity of adoption behavior to improve the system of closed adoption becomes imminent.%秘密收养作为一种主要的收养方式，在整个收养制度体系中扮演着不可替代的角色。虽然公开收养的出现在一定程度上动摇了秘密收养的法律地位，但秘密收养依然有广阔的生存空间。然秘密收养制度毕竟保留了与生俱来的缺陷，不得不予以规避。鉴于此，通过协调送养人隐私权与被收养儿童知情权之间的冲突、细化责任承担方式、明确收养行为效力等举措来完善秘密收养制度就变得迫在眉睫。
