“操”字状一经报道便引起激烈的讨论，而拘留决定的作出更将此事推向了高潮。方孔先生从人的理性和法律的理性出发，指出“操”字状并未侮辱司法工作人员及法律，但其观点过于理想化且未考虑我国国情。“操”字状中折射出的言论自由、社会常理、司法权威等法治问题引人深思，笔者认为言论自由应存在一定的界限，理性的法律应包含社会常理，司法权威应得到进一步加强。总之，反思该案将为建设社会主义法治国家提供不少经验和启示。%The report on the case of “Cao”character caused a heated discussion,and the detention made this case to a climax.In perspective of human rationality and reason,Mr.Fang Kong pointed out that the case of“Cao”character in petition for appeal that doesn’t insult the judicial clerks and laws,however,the view is so idealistic without considering the national conditions of our country.The case of “Cao”character reflects some problems such as the freedom of speech,social convention,and judicial authority.It is believed that freedom of speech should be limited in certain boundaries,the rationality of the law should include the conventions of the society,and the judicial authority should be further strengthened.In a word,the rethinking will provide some experiences and enlightenments for construction of socialist China ruled by law.
