论自动驾驶事故的法律责任归属

             

摘要

The feature of self-driving technology, intellectualization and automatization have impact on existing law objectively. The preliminary problem is the difficulty of application of existing law on authorizing road testing and market entry, unification of standards for technology and safety, and affirmation of legal responsibility of car accidents. Therefore, it is necessary to carry out special authorization or legislative amendments to tackle problems of legal responsibility affirmation in areas of administrative law, civil law and criminal law etc. The legal obstacles should be cleared, so that development of law and regulations can keep up with that of technology of standardizing and guiding the same.%自动驾驶技术智能化、自动化的特点客观上对既有法律造成了冲击,初步产生了诸如上路测试、市场准入难以依现有法律取得授权,技术、安全等标准难以统一,事故的法律责任难以认定等问题.应该通过特别授权或进行适度的立法修改,解决在行政法、民法、刑法等领域的事故法律责任等问题,清除不必要的法律障碍,使法律法规与技术研发相匹配,发挥法律的规范和引导作用.
