2014年12月22日公布的《不动产登记暂行条例》,必将对以往不太规范甚至有所混乱的不动产登记带来可以预期的制度性改善,其本身也实现了不动产登记机构、登记簿册、登记依据和信息平台的“四统一”。然而,《不动产登记暂行条例》对不动产登记的效力并没有作出明确的统一规定,于是产生了选择登记对抗主义还是登记生效主义的困惑。应该说,两种模式各有优劣,可谓伯仲难分,抑或创造出第三种不动产的效力模式亦不失可能。但这终究有赖于立法到位,将来适时制定《不动产登记法》应为根本上的期待之举。%“The Provisional Regulations on Real Estate Registration” ( published on De-cember 22d,2014 ) will regulate the non-standard real estate registration which may also im-prove the system by integrating the institution , register books , register reference , and informa-tion.However ,there is no definite standard for the effectiveness .This leads to the confusion of choice making———whether go against it or follow it .The advantage and disadvantage are both obvious.All of these depend corresponding laws .
