The reform of income distribution is a major project of the party and government in recent years. Meanwhile, the fairness of income redistribution has been a topical issue. This article, which is based on externality, approaches that negative externality of economy is the essence of unfair income distribution. According to the principle of externality, this problem needs to be adjusted by external interference. Therefore, under the background of rule of law, economic law is the inevitable choice to adjust the income distribution.%收入分配改革是近年来党和政府着手进行的一项重大改革内容,收入再分配的公平性问题也一直是经济社会关注的热点. 从外部性视角进行分析探讨,提出收入分配不公平问题的实质就是经济的负外部性问题,根据外部性原理,这一问题需要借由外部干预来进行调整,在依法治国的大背景下,作为国家调节经济活动的基本法——经济法就成为调节收入分配问题的必然选择.
